Default
The Ohio Revised Code §3121.01 defines default as “any failure to pay under a support order that is an amount greater than or equal to the amount of support payable under the support order for one month.”
If you do not pay your full monthly obligation every month, your case will go into default when you owe more than one month’s total obligation. A payment will be added to pay down the balance you owe.
This is an automated process.
A notice is issued when your case enters default. An additional 20% payment of the current support amount (unless the case already has a court ordered payment on arrears) will be added onto the monthly obligation to pay down what you owe.
You have 14 days from the date on the notice to object in writing to the additional payment and request a Mistake of Fact hearing.
You will remain in default even if you start paying. YOUR CASE WILL NOT LEAVE DEFAULT UNTIL ALL BALANCES ON THAT CASE REACH ZERO.
Things that can happen while you are in default even if you are paying:
- Passport block
- Seizure of financial accounts
- License suspension
- Credit reporting
- Liens on real and personal property
- Seizure of gambling winnings including lottery and casino winnings
- Seizure of settlements, claims or awards
